This Privacy Policy describes the types of information we collect from you when you visit  or interact with our website, located at the URL https://www.outsell.com (referred to as the “website”) provided by Outsell (also referred to as “Company”, “we”, “our”, or “us”), your business purchases and implements our products and services, or otherwise interact or communicate with us online or offline.

Note, we provide customer engagement, marketing, and data analytics services to automotive dealers. In such cases, the dealer determines the purposes and means of the processing of the personal information of consumers, and we process such information on their behalf and at their direction. By using the website, you consent to the collection, use, and disclosure of your information by Company in accordance with this Privacy Policy. We reserve to make changes to our privacy policy at any time for any reason. Unless we are acting in our capacity as a service provider to automobile dealerships, this information is often the personal information found on a business card.

    • Contact information – first name, last name, email address, mailing address, billing address, telephone number, and employer and employment details.
    • Account information – if you are a registered user of our services, your username, account password, account number, and other information that we may request or that you may provide relating to your account.
    • Transactional information – details about your, or your company’s, transactions with us, including method of payment, payments received, payment details, transaction history, and other information relating to the services purchased by you or your company.
    • Payment information – in connection with your use of our services, your payment method and details. Note, payment processing is handled on our behalf by a third-party service provider. 
    • Marketing information – details regarding informational and promotional materials you may have requested or received from us, the services in which you are interested, your receipt of promotional communications, and information on your marketing or communication preferences.
    • In-app communications – copies of communications and inquiries you transmit or submit via our software-as-a-service platform, including through email, telephone call, video call, chat, and similar features available in our services.
    • Customer support information – details of any communications or inquiries you submit to us, including technical or customer support requests, through email, calls, or other features available in our software applications.
    • Device and usage information –details regarding how and when you use our website, including the device used to connect to our services and applications, your IP address and device identifier, the frequency and duration of your usage, the pages you view, what websites or search terms referred you to our website, and information about your interaction with our website.
    • Job applicant information – If you are a job applicant, we may also collect information about you that you submit to us via our “Careers” page on our website or a third-party platform to which we post job openings (e.g., LinkedIn). As part of your application, we may collect your contact information, education and previous employment information, and resumes, cover letters, or other relevant documents.       We collect this information when you access, use, or navigate our website (including our software-as-a-service platform), fill in forms on our services, request information via our website or applications, communicate with us (including by phone, email, chat, or otherwise), interact with any chatbot or similar features available on our website, visit or engage with our social media pages, participate in surveys or sponsored activities, or otherwise provide us with personal information. Our offline collection of information includes information you provide to us directly (whether or not in person), including at trade shows or similar events or that we may gather on-site when doing a demo of our products.

      Please note that we may aggregate or anonymize the foregoing types of data such that they are no longer capable of identifying you, in which case they are no longer considered “personal information.”
  2. Automatically Collected Usage and Device Information

    Like most website operators, we use various technologies to automatically collect the following types of information about you:
    • Cookies. Cookies are small text files that a website transfers to a visitor’s device for recordkeeping purposes.  We use cookies to personalize visitors’ experiences on our website, provide content that we believe may be of interest, track visitor trends and patterns, engage in marketing and advertising, and otherwise analyze our website traffic.   Outsell employs cookies in order for its server to recognize a return visitor as a unique user. Cookies are small text files placed in the ‘Cookies’ folder on a visitor’s hard disk and allow Outsell to remember the visitor. The cookies placed by Outsell server are readable only to Outsell, and cookies cannot access, read, or modify any other data on a computer. All web-browsers offer the option to refuse any cookie. If a visitor refuses the Outsell cookie, Outsell does not gather any information on that visitor, but doing so will require you to re-enter certain information at each visit, or prevent us from customizing the website’s features according to your preferences.     • Pixels and Web Beacons. Some Outsell and customer hosted websites may also use “Pixel” and “Web beacon” technologies. Pixels and web beacons are small piece of code that is placed on a website or email that are used to monitor the behavior of website visitor or email recipients—such as what pages were visited or whether links in an email were opened—and gather analytics.  For example, when a visitor accesses pages on the Outsell or a customer’s website with a pixel or web beacon, an anonymous notice of that visit is generated which may be processed by us or by our vendors. These web beacons, in turn, work in conjunction with cookies to let us know what portions of our website are of interest to our visitors and to help us provide you with tailored information from our website. If you turn off cookies, pixels and web beacons may still detect certain information and disregard any cookie-prohibitive markers or signals. Please note that pixels and web beacons may transmit information regarding website visitors to third parties, who may then use that information for marketing, tracking, or other similar purposes.     • Log file information. Log file information is automatically collected from your browser or mobile device each time you access Outsell’s website and services. When you use our services, our servers automatically record certain log file information. These server logs may include anonymous information such as your web request, device type, operating system type, Internet Protocol (“IP”) address, mobile device identifier provided by your mobile device operating system, browser type, domain name, pages viewed, referring / exit pages and URLs, open and click engagement thus showing us how you interact with links on the Services, as well as the language your system uses and the country and time zone where your device is located.

      The information collected through these technologies may be combined with personal information. We may share information about your use of our website with our advertising and analytics partners, who may combine it with other information that you previously provided to them.
  3. Information from Other Sources

    We may obtain both personal and non-personal information about you from affiliates, business partners, vendors, contractors, suppliers, and other third parties and add it to other information we have collected. For example, if you are part of an automotive group, we may collect your information from your affiliates or related businesses. We may also receive information about you from your vendors and service providers we partner with to provide your company our services. We, and the third parties we engage, may combine information we collect from you over time, and across our services, with information obtained from other sources.  This helps us improve the information’s overall accuracy and completeness, and also helps us better tailor our interactions with you.
  4. Information from Social Media

    If you interact with us on any social media platform: (i) depending on your social media privacy settings, the personal information that you submit on the social media platform may be read, collected, or used by us as described in this Privacy Policy, and (ii) where we respond to any interaction with you on social media, your account name/handle may be viewable by any and all members or users of our social media accounts.  Social media platforms operate independently from us and we are not responsible for the personal information that you choose to submit or link on any social media platform.  We encourage you to review the privacy policies and settings of any social media platform with which you interact to help you understand their privacy practices.

Email Marketing & Consent

We provide marketing services to our dealer customers. If you are receiving an unwanted or unsolicited email from an automotive dealer, please contact the dealer directly by visiting the dealer’s website.

We will send marketing emails to our contacts and leads, where the law allows. You can opt-out of receiving marketing communications from us, by following the “Unsubscribe” link and instructions at the end of any email or contacting us at the contact information below.

How We Use Your Information

Outsell (or the service providers acting on our behalf) uses your personal information to register you to use Outsell’s services, contact you to deliver certain services or information you may have requested, verify your authority to enter into certain areas of the website, improve the content and general administration of the website and our services, provide you with notices regarding our services, and, with permission, provide visitors with updates and information about Outsell and its services. We (or the service providers acting on our behalf) also use the persona information identified above for the following purposes:

  • Negotiating, entering into, and managing our business relationship and agreements with your company, including providing our services to, and processing payments from, your company. 
  • Providing and optimizing your experience on our website and applications and ensuring that our content is presented to you in the most effective manner. 
  • Communicating with you and responding to your inquiries and communicating regarding our services, our agreements with you or your company, and other issues.
  • Sending you promotional or informational communications and solicitations, tracking your marketing preferences, and for our internal marketing purposes.

These third-party sites and services are not under our control. Dealer customers should consult the applicable dealer’s privacy notice as we have no control over information that is submitted to, or collected by, any automotive dealer.

When the information we collect is aggregated, anonymized, or otherwise does not identify you, it is no longer considered “personal information.” We may use such information for any purpose or disclose it to third parties, to the extent permitted by applicable law.

We may disclose your personal information to the following types of third parties:

  • Business partners and third-party vendors necessary for the performance of any contract we enter into with you. For example, our IT providers, secure payment processing providers for the services, customer contact center services, insurance providers. We also partner with your company’s vendors and service providers to provide our services, which may require that we disclose certain of your information to such vendors or service providers.
  • Service providers we use to facilitate our business operations and administer our services. These third parties have access to your personal information to perform specific tasks on our behalf. For example, our service providers include (i) IT and system administration providers, (ii) data storage providers, and (iii) web hosting providers.

  • Cookies, Pixels, and Similar Technologies – Depending on your browser or device, you may have the option to set the browser to accept all cookies, reject all cookies, notify you when a cookie is set, or delete cookies.  Likewise, your email account, social media account, and device account settings may allow you to turn off pixels and similar technologies.  Each browser and device are different, so we recommend you evaluate the tools and settings available in your browser or device, as well as any available instructions for the same.  Please note that if you disable or delete cookies, you may not be able to access or use certain features of our website or services.

Anti-Spam Policy

Outsell has a comprehensive Acceptable Use Policy (“AUP”) for customers, available at https://www.outsell.com/acceptable-use-policy/ prohibiting the use of our services and servers to send unsolicited commercial email. Outsell requires ALL its customers to agree to adhere to the AUP at all times. Outsell continues to actively review and implement new auditing technology such as seedlist monitoring, complaint monitoring and email failure monitoring to ensure compliance with its AUP. Any violations of the AUP can result in immediate suspension of service or breach of contract

Children’s privacy

Our website or products and/or services are not intended for children under 16 years of age. No one under age 16 may provide any information to or on the website. Outsell does not knowingly collect personal information from or relating to children under 16. If you are under 16, do not use or provide your e-mail address or any personal information us or the Dealer through the dealer website or any of the various signup forms. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. Outsell is headquartered in the United States and conducts business solely in the United States.  As a result, the information you provide to us resides on servers or workstations located in the United States.
